The agreement reached between PSIB, Més per Mallorca, and Més per Menorca with the PP bans the construction of new projects in flood-prone areas but continues to allow amnesty for illegal houses and activities on rural land without requiring compliance with the minimum standards of spatial planning regulations.
The Government’s decree, which will gain approval in Parliament today based on the new parliamentary agreements, also allows new buildings to be constructed in other risk areas, such as those prone to wildfires, landslides, and erosion.
It further introduces provisions to legalize homes that are currently out of planning regulations and grants “positive silence” for processes concerning illegal constructions. This new law represents the largest speculative operation ever undertaken, a shameful move by a government that rewards violators.
The GOB believes that the new legal texts retain and add unconstitutional elements and urges opposition parties to take action in this regard, both through the central government and regional parliaments.
The provision enabling the legalization of constructions on rural land is an arbitrary rule, as it creates inequities among citizens.
Anyone wishing to build on rural land is required to meet strict criteria, such as owning a minimum plot size, adhering to maximum height and volume limits, and following urban planning parameters. They must also hire qualified professionals and pay the appropriate licensing fees.
Now, thousands of illegal constructions are set to be legalized without demanding compliance with the requirements that law-abiding citizens must fulfill.
